Dwight James of Farm Site, Sandy Point, St. Kitts, has been sentenced to serve eighteen (18) years in His Majesty’s Prison for the offence of Manslaughter by Virtue of Diminished Capacity.
Manslaughter by Virtue of Diminished Capacity- is where a person’s criminal liability is reduced due to an impaired mental state. It is not a complete defence like insanity, but mitigates the charge from murder to manslaughter.
James, 34, was originally charged with Murder, the criminal act having been committed on August 8th 2022 and resulting in the death of Luis K. James, also of Farm Site, Sandy Point.
Mr James pleaded guilty to the charge on November 28th 2024, and was sentenced February 3rd 2025. His time spent on remand will count towards his sentence, and he will be eligible for early release after serving a third of his sentence with good behaviour. The sentence was handed down at the High Court in Basseterre, by His Lordship Justice Iain Morley, KC.
